The Department of Transportation (DOT) discussed important details in a notice for DOT-safety-sensitive employees on the use of CBD that are subject to drug testing on February 18, 2020. Safety-sensitive employees include pilots, school bus drivers, truck drivers, train engineers, transit vehicle operators, aircraft maintenance personnel, fire-armed transit security personnel, ship captains and pipeline emergency response personnel. 

The important points of the notice include:

1. DOT requires testing for marijuana (THC) and not for CBD.

2. The labeling of many CBD companies may be misleading because the products could contain higher THC levels than the product label describes.

3. The DOT’s Drug and Alcohol Testing Regulation, Part 40, does not authorize the use of Schedule 1 drugs, including marijuana, for any reason.  Therefore, CBD use is not a legitimate medical explanation for a laboratory confirmed marijuana (THC) positive test. 

Since the use of CBD products could lead to a positive THC drug test result, DOT-regulated safety-sensitive employees should exercise caution with the use of CBD products. 

This notice emphasizes the importance of obtaining CBD lab results when one does consider CBD use with an occupation that requires drug testing.
